New Data Bill Spells Out Exemptions, But Opposition Parties, Experts Decry Govt’s Powers

The Digital Personal Data Protection Bill (DPDPB), 2023, tabled in the Parliament on Thursday has detailed certain scenarios in which the protection to users under the provisions of the Act will not be applicable. Members of the Opposition and some technology policy experts have raised concerns as this gives wide ranging powers to the government.
Venkatesh Krishnamoorthy, Country Manager – India, for BSA | The Software Alliance said that the 2023 Bill relies heavily on individual consent and contains an extremely narrow set of ‘legitimate uses’ for which personal data may be processed without consent. This is out of step with leading global data protection laws. This narrow approach creates significant practical concerns for companies and may lead to voluminous consent requests to individuals. We recommend that the Bill restore provisions from the 2022 DPDP Bill, including permitting processing in the public interest and processing that is ‘fair and reasonable. This change would also better align with India’s desire to promote the development and use of AI technologies.
