BSA Urges US-Kenya Commitment to Strong Digital Trade Provisions

WASHINGTON – April 28, 2020 – In comments submitted to the Office of the US Trade Representative (USTR), BSA | The Software Alliance urged USTR to prioritize digital trade in its upcoming US-Kenya trade negotiations. Strong bilateral digital trade commitments, especially on cross-border data flows, offer a tremendous opportunity for US and Kenyan bilateral economic integration. Robust commitments on cross-border data transfers and on other digital trade issues facilitate the development and deployment of technology, enhance productivity, and are critical to economic development. To ensure that their industries have access to best-in-class software technologies and services, the United States and Kenya should commit to ambitious provisions based on prior US digital trade agreements, including the US-Japan digital trade agreement and the digital trade provisions of the USMCA. BSA looks forward to engaging with both countries on these negotiations as they progress.
